1. About These Terms

This website is operated by Brandon Park Lotto Cards & Gifts (ABN XX XXX XXX XXX), trading as Brandon's Gifts ("we", "us", "our"), of Shop 2, Brandon Park Shopping Centre, Springvale Rd, Wheelers Hill VIC 3150, Australia. By accessing this website or placing an order, you agree to these Terms and Conditions, our Privacy Policy and our Returns & Refunds Policy. If you do not agree, please do not use this website.

2. Australian Consumer Law

Our goods come with guarantees that cannot be excluded under the Australian Consumer Law. You are entitled to a replacement or refund for a major failure and compensation for any other reasonably foreseeable loss or damage. You are also entitled to have the goods repaired or replaced if the goods fail to be of acceptable quality and the failure does not amount to a major failure. Nothing in these terms excludes, restricts or modifies any consumer guarantee, right or remedy conferred on you by the Australian Consumer Law or any other applicable law that cannot lawfully be excluded, restricted or modified.

3. Orders and Acceptance

Your order is an offer to purchase. An order confirmation email acknowledges receipt of your order but does not constitute acceptance. We accept your order when we dispatch the goods or notify you that your Click & Collect order is ready. We may decline or cancel an order before acceptance — for example where a product is out of stock, where payment cannot be verified, where our fraud-screening checks flag the transaction, or where a pricing or description error has occurred — in which case we will refund any amount you have paid in full. We may also restrict or block access to the website (including by IP address) where we reasonably suspect fraudulent or abusive activity.

4. Pricing, Payment and GST

All prices are in Australian Dollars (AUD) and, where applicable, include GST. We take care to ensure prices and product details are accurate, but errors may occur; where we identify an error affecting your order before acceptance, we will contact you with the option to reconfirm at the correct price or cancel with a full refund. Payment is processed at the time of ordering by our third-party payment providers — Stripe (including Apple Pay and Google Pay wallet payments), PayPal (including PayPal Pay in 4) and Afterpay — except for Click & Collect "pay in store" orders, which are paid on collection. We never receive or store your full card details — card and wallet payments are tokenised in your browser and handled by the payment provider under PCI-DSS. Your use of a payment provider is also subject to that provider's own terms.

5. Promotions and Discount Codes

Promotions and discount codes are subject to any conditions published with them (such as dates, minimum spend, eligible products or usage limits). Unless stated otherwise, codes cannot be combined, have no cash value, and are limited to one use per customer. We may correct, suspend or withdraw a promotion at any time in respect of orders not yet accepted, including where a code has been published, generated or used in error. Where a discounted order is refunded, the refund is based on the amount you actually paid.

6. Delivery, Risk and Title

Delivery methods, areas and indicative timeframes are described on our Delivery Details page. Delivery timeframes are estimates only and may be affected by carrier delays outside our control. Please ensure your delivery details are accurate — we are not responsible for delivery failures caused by an incorrect or incomplete address you have supplied, although we will reasonably assist in recovering or redelivering the goods (redelivery costs may apply). Risk in the goods passes to you on delivery to your nominated address or on collection in-store; title passes when payment is received in full.

7. Click & Collect and Pay in Store

Click & Collect orders can be collected from our store during opening hours once we notify you they are ready. For pay in store orders (where you reserve online and pay on collection):

• a verified email address is required, and each customer may have one active pay-in-store order at a time;
• stock is reserved for 5 working days (Monday–Friday, excluding Victorian public holidays) from the day the order is placed, and we will send you collection reminders during that period;
• if the order is not collected and paid for by the end of the 5th working day, it is automatically cancelled and the stock is released — as no payment has been taken, no refund is due; and
• we may ask for your order number and reasonable proof of identity at collection. Orders you have already paid for online are never cancelled under this clause and will be held for you.

8. Product Information

We aim to describe and photograph products accurately. Colours may display differently on different screens, and packaging or design may occasionally vary from images shown. Some product descriptions are prepared with the assistance of automated tools and are reviewed for accuracy; if any detail is important to your purchase, please contact us to confirm it before ordering. This section does not limit your rights under the Australian Consumer Law where goods do not match their description.

9. Accounts and Acceptable Use

You must provide accurate information when creating an account or placing an order. You are responsible for keeping your account credentials secure and for activity that occurs under your account, and you must notify us promptly if you suspect unauthorised use. You agree not to: use the website for any unlawful purpose; attempt to gain unauthorised access to any part of the site or its systems; interfere with the operation of the site (including by scraping, probing or load testing without permission — see our Security & Responsible Disclosure page); place orders with no genuine intention to pay or collect; or submit false, misleading or infringing content. We may suspend or close accounts that breach these terms, and you are responsible for loss or damage we reasonably incur that is caused by your breach of these terms or your unlawful use of the website, except to the extent we contributed to that loss.

10. Lottery Information

We are an authorised retailer of The Lott products in-store only. Lottery jackpot amounts and draw information displayed on this website are sourced from third parties, are indicative, provided for general information only, and may be delayed, incomplete or change without notice — lottery products cannot be purchased through this website and you should not rely on this information for any purchasing decision. 11. Intellectual Property

All content on this website — including text, graphics, logos, images and software — is owned by or licensed to us and is protected by law. Product names, brand names and trade marks (including Hallmark and The Lott) remain the property of their respective owners. You may not reproduce, distribute or commercially exploit our content without our written permission.

12. Website Availability

We may change, suspend or discontinue any part of the website (including product ranges, features and content) at any time without notice. We do not guarantee that the website will be available, uninterrupted, secure or error-free, and we may restrict access for maintenance, security or legal reasons. Orders already accepted are not affected by changes under this clause.

13. Limitation of Liability

To the maximum extent permitted by law (and subject always to clause 2):

• we exclude all warranties, conditions and guarantees not expressly set out in these terms or imposed by law;
• our total aggregate liability to you in connection with any order is limited to the amount you paid for that order, and our liability in connection with the website where no order has been placed is limited to AUD $100;
• where a consumer guarantee applies but may lawfully be limited, our liability for goods is limited (at our election) to replacing the goods, supplying equivalent goods, repairing the goods, or paying the cost of doing any of those things;
• we are not liable for indirect or consequential loss, loss of profit, loss of revenue, loss of opportunity, or loss or corruption of data;
• we are not liable for delay or failure caused by events outside our reasonable control (including carrier delays, supplier shortages, industrial action, natural disasters, and outages of third-party services such as payment providers or hosting infrastructure);
• we are not liable for the acts, omissions, terms or privacy practices of third-party payment providers, delivery carriers or other third-party services you interact with in connection with your order; and
• the website and its content are provided "as is" and we do not warrant that they will be uninterrupted, error-free or free of harmful components.

14. Third-Party Links and Services

This website may link to third-party websites (such as payment providers, social media and The Lott). We are not responsible for the content or privacy practices of third-party sites, and links do not imply endorsement. Your dealings with third parties are solely between you and them.

15. Changes to These Terms

We may update these terms from time to time. The version published on this page at the time you place an order applies to that order.

16. General

If any part of these terms is found to be invalid or unenforceable, that part is severed to the minimum extent necessary and the remainder continues in full force. A failure or delay by us to enforce any right under these terms is not a waiver of that right. These terms, together with the policies they reference, are the entire agreement between you and us in relation to your use of the website and your orders.

17. Governing Law

These terms are governed by the laws of Victoria, Australia, and you submit to the non-exclusive jurisdiction of the courts of Victoria.
